Update on South Florida Short Sales. Banks are finally cooperating in getting the transactions closed.

Either we`re on a lucky streak or the lenders have become very eager to cooperate with unloading inventory that has been on the market in some cases 10 months or longer.
During the past 4 month`s we`ve been in a log jam with several different lenders awaiting a final decision on accepting the "Terms and conditions" of the sale of Condominiums, Single Family homes and Town Homes", in which we`ve listed or had buyer`s place offers on.
One thing is very certain, if you`re going to list a "Short Sale" you better have done your due diligence in regards to pricing and paper work.

I can`t tell you how many times during the course of the year we`ve received offers from others who are requesting the sublime in offers. Without being somewhat realistic with you`re clients, it`s just futile in getting the lenders to accept an offer, if you`re smart enough and have a savvy investor or buyer who understands their purchasing a home $50-$75,000 undervalue.The sky does become the limit.
Here are a few tricks of the trade we`ve learned when dealing with the lenders.Although the lenders aren`t requiring "Comps" sending them with your offer is a very good idea.

If the lenders are set to do a BPO, make sure to schedule an appointment for you to attend.Many, times those who are doing the BPO`s never bother to show up and look inside a home. They just send in a BPO,without much effort.
When you ask to be present when the BPO is conducted the world suddenly opens up and that`s good.

Have all paper work done properly, try not to be too creative with financing terms and conditions. Don`t make outlandish demands! Think Smart!
Make damn sure monies are placed in escrow before hand, don`t waste time writing in your offer`s "Escrows Upon Acceptance", it`s a complete waste of time, the lenders and the committee's that deal with these offers want to know there is "Money" behind these offers.
With that said, placing only $500.00 in escrow is a "Red Flag" as well. The more money you show as a deposit, the faster the lenders seem to look at the offer! Quite frankly, I`ve listened to some of these "Short Sale Guru`s" proclaim you don`t need to show escrow, it`s "NOT TRUE"..
Cuba Gooding said it the best when he said "Show me the money", the more you show the more the lenders respond!
Save all emails make sure to "CC" everyone when it comes notifying all facets of the transactions. The lenders love to have experienced Title companies take the grunt of the work away from them. It`s a real burden for the lenders to be on "Overload".
If the lenders counter, with your offer, great! Make sure you write the addendum, have all parties sign and immediately notify the lender of the acceptance, whatever you do "Don`t wait too long"...

If your involved with an HOA and a lien on the home get your ducks in a row by contacting the HOA attempting to work out a solution before the lenders have too. A smart HOA and it`s attorney`s will in fact work with you in attempting to resolve any liens on the home.
Again, nothing is easy in a "Short Sale", having an experienced Realtor and a good staff behind you will ease the burden and make things happen a lot faster.

Sellers, Don`t try to attempt to do a Short Sale by yourself!
The unimaginable has happened!
We received a call from a person who`s in alot of trouble with their home and is unable to make the next mortgage payment.
This person needs someones assistance but quite frankly believes they can contact the Banks,attorneys and begin the process of "Doing a Short Sale" by themselves!
As many FSBO`s will tell you selling a home isn`t easy under any circumstance, attempting to complete a "Short Sale" by yourself is dangerous and risky.
We offered this person our Professional help.It was our opinion, this person was already pushing the envelope by missing two mortgage payments, her concern was "Our Commission was too high".
Now that`s one for the books, the person is caught between a rock and a hard place and all she can think of is our "fee" for helping her get out of this horrible situation. Real Estate brings out the best in some people, I guess!
I don`t know about you but, when I need someone`s help especially when it comes to doing something this complex I like to hire an expert. I don`t want to waste time, i want to make sure that I have the best person capable of doing the job!
Completing a "Short Sale" isn`t easy, it requires time,effort,patience and most of all a staff of professionals who along the way know how to deal with glitches that will definitely occur.
Back to the "Do-it yourself`er Short Seller", she explained to us that nobody would deal with her through the lender,no attorney would speak with her and the Realtors in her area aren`t comfortable dealing with this type of a sale!
Yet, she`s calling us to speak to our attorneys, and refuses to sign a listing contract in order to proceed. The fact is "Time" is running out for this person and the doors are closing fast.
Attempting to deal with lending intuitions and selling your home when you`re in dire need to do so by yourself is a recipe in self destruction.
We wish this person the very best and pray that she awakes from her coma and seeks professionals who can save her from herself!

Range Pricing Trips up Seller and Agent.
I must admit we`re a bit perplexed about an offer we sent to another agent in regards to a listing.
The home is located in Davie, Florida. It`s listed on the MLS for $445,000. In the remarks section it states "Range Price $445,000-$465,000".
I`m a firm believer that when a Buyer wishes to place an offer on a home, you start writing if the offer is in reason. In this case, the offer was well in reason. We sent our offer to the other agent for $439,000.
The other agent received our offer became "HIGHLY AGITATED" and wrote me a letter informing us that " Our seller refuses to accept your offer because it`s not in their Range Price!" Not in a Range Price, I start laughing to myself. In a market like this?!
Interesting how aloof this agent was towards both myself and the potential buyer.
Range Price is meaningless,if a buyer places an offer, you either counter, or you don`t. It`s not cause for an agent to have a "Mental Breakdown"..
Oddly enough, the home has been on the market since Sept. There hasn`t been much activity on this listing. The agent should have handled our offer differently.
I decide to call the other agent, who seemed annoyed that I would have the gall to contact him!

Me:I received your letter detailing that the seller is upset because we didn`t follow your "Range Price". I never realized that we had too!

Range Price Aficionado: You and you`re buyer are not following our rules! We won`t entertain any other offers.

Me: In a market like this, I`m taught that we work with each other, not alienate a buyer from purchasing a home, especially since it`s been on the market for almost 6 months!

Range Price Aficionado: My seller won`t look at other offers... You better hurry, we`re getting tons of activity on this home!

Me: Really? I suggest that you counter, I`m calling your bluff.The comps in the area tell me that our offer is "On Target". If we don`t hear back from you by Monday morning, we`ll rescind our offer and move on!

I have been in many transactions, lesson number one is to always present an offer to your seller and let the seller decide,not take an offer personally because you opt to have a "Range Price" on the MLS.
I have a very strange feeling the agent will finally sit down with the seller and discuss our offer.Range Pricing or not!

Property Taxes need to be revamped!

South Florida homeowners angry about high tax bills -- and the threat of paying even more if they move -- can sound off to legislators, Democrat and Republican alike, at meetings on the topic early next month. Eight town-hall-style hearings will be held across the state, including hearings in Lake Worth, Fort Lauderdale and Miami.Legislators have set the stage for a big debate at the legislative session scheduled to start in March.Gov. Charlie Crist and many legislators want to trim the taxes people pay on their homes. They are talking about a constitutional amendment that legislators would write and voters could approve as early as this summer. The proposal, for starters, would double the current $25,000 homestead exemption, which lowers the assessed value of a home. Under the existing exemption, the owner of a $200,000 house pays property tax on $175,000 of that value.The Republican governor also wants to let homeowners take some or all of their so-called "Save Our Homes" tax savings if they move.
That 24-year-old constitutional provision caps tax increases at 3 percent a year no matter how much the value of a home increases. But those savings are lost when a homeowner moves, and the cap doesn't apply to businesses, rental properties and vacation homes.

This month, Crist and legislators enacted changes to drastically cut property insurance rates. But property tax cuts might be a bigger fight.Local government officials say tax cuts of any significance will siphon money from everything from local parks to the salaries of police officers, firefighters and teachers.

Several weeks ago I began to really focus placing our newsletters,pictures and now Active Listings on Localism.com.
I didn`t know what to expect! I was curious how it would enhance our presence on the net and I wanted to see if the area`s we concentrate in would be noticed by Google Base and Yahoo. I had no idea how "POWERFUL" this marketing Tool is!
I started using Localism in our listing presentation with potential sellers, they flipped! Many understand that in order to have a property noticed in todays competitive market we need to "Leverage the Net",which means using any and all means to insure a property is marketed. I know that Colleen fully understands how this helps her marketing a property!
What really has me convinced that Localism.com is the "Wave of the Future' is the telephone inquiries that have started.
